Buying a second-hand car is likely to be the second biggest purchase you will ever make. It is also a purchase that creates the most complaints. Knowing how to reject a car and your consumer rights is crucial. Unscrupulous car dealers rely on tried and tested tactics to deny you a remedy, knowing that most consumers do not know how to reject a car and assert their consumer rights.

What grounds can you reject a car?

You can reject the car if the vehicle is not fit for purpose, as described, satisfactory quality or does not match the description you were given.

Cosmetic issues or minor faults are not valid reasons to reject a vehicle.  

Can I return a car if I am not happy with it?

You can if you bought it online under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This is commonly referred to as ‘Distance Selling Regulations’ and provides a ‘cooling off’ period.

This applies to distance selling purchases where you have not had the opportunity to inspect the goods. You have up to 14 days to notify the seller in writing to return the goods, and another 14 days thereafter to do so.

This does not apply if you have bought the car from a showroom and had the opportunity to inspect the vehicle and test drive it.

Can I return a used car within 14 days?

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 gives you the right to cancel or return your vehicle from the moment you place your order until 14 days after it has been delivered.

This only applies if the entire buying process was completed online and you did not have the opportunity to inspect or discuss the vehicle purchase in person.

It does not apply if you visit the forecourt to collect the car, pay a deposit or sign any forms or documentation onsite.

Car dealers will often cite the car is ‘bespoke’ to push back on this. A set of wheels as part of a manufacturer’s options on a car does not make it bespoke.
